A decision on Sunday penalty rates may still be months away after the Fair Work Commission sought more evidence from employers pushing for rate cuts.

The commission has told the Australian Industry Group it needs to make further submissions in relation to assumptions the employer organisation made about a survey of fast-food workers and their preferences for weekend work.

The assumptions have been disputed by the union representing the sector's workers and the commission will hold a special hearing on September 28, meaning a decision is unlikely before December.
