Homicide detectives have released a 31-year-old man from custody following the death of a homeless man in Melbourne's east.

The man's partner contacted police about 5am yesterday after noticing an individual acting suspiciously in the front yard of their home on Gladstone Road in Dandenong North.

The 31-year-old then confronted the 37-year-old man, before following him to Carlton Road - about a 12 minute walk - where a psychical altercation took place.
