Covert surveillance of a disability pensioner, because he likes to feed birds in his own yard.

Statement from Bayside City Council

Mr Martell’s bird feeding was significantly impacting his neighbours. They had tried to resolve the problem before involving council. Under local law it is an offence to feed birds where it affects another person or their home. Council has been trying to resolve the issue since May 2017. Gathering evidence and taking the matter to court in order to enforce the local law was, and is always, a last resort.
