A commuter is blaming a spooky advertisement for the TV series Dexter for falling down a set of stairs and breaking her ankle in a New York subway.

Ajanaffy Njewadda and husband Sheik Ahmad Tejan Wadda have launched a lawsuit in the Bronx Supreme Court against the US city's transit authorities as well as the show's producers, Showtime, the New York Post reports.

Ms Njewadda describes in her lawsuit being confronted by a "shocking and menacing" publicity image of Dexter star Michael C. Hall painted over an entire staircase, while exiting a train on June 20 last year.

The ad shows Hall wrapped in plastic.

In the show, Hall's character, a mild-mannered crime scene investigator, executes criminals who beat the justice system and then wraps their bodies in plastic.

The lawsuit said the image "startled, shocked and overwhelmed" Ms Njewadda, causing her to "panic and become fearful" and lose her balance on the steps.

New York's Metropolitan Transportation Authority is yet to respond to the legal action.
