Sleeping man sues ESPN for $10 million

A New York Yankees fan is suing ESPN for $10 million after being caught on camera sleeping at a baseball game.

The 26-year-old man has filed a defamation suit against the announcing team of Dan Shulman and John Kruk after claiming he was called "fatty, unintelligent and stupid" by the commentators.

The video captured Andrew Robert Rector slumped with his head hanging to the side during the fourth innings of an April 13 game against the Boston Red Sox at Yankee Stadium, but none of the insults allegedly used by the commentators can be heard.

ESPN commentators allegedly then began unleashing an "avalanche of disparaging words" .

"It's not the place you come to sleep", one of the announcers said after a camera man spotted the napping fan.

Rector said the comments and subsequent video of him uploaded to the internet by the Major League Baseball caused "intentional infliction of emotional distress".

"These unmitigated verbal onslaughts crossed the line between reporting on sport and abuse against the plaintiff without reasonable cause or restraint," Rector's suit said.

The suit also names Major League Baseball, ESPN and the New York Yankees as defendants.

ESPN refused to comment about the suit.
