WorkSafe drops charges against Rye Easter Carnival ride operator

Charges have been dropped against an Easter show ride operator, after a six-year-old boy fell to his death in Victoria.

Eugene Mahauariki died after falling from the Cha Cha ride at the 2017 Rye Easter Carnival.

WorkSafe Victoria today told Melbourne Magistrates Court it was withdrawing charges against ride operator Wittingslow Carnivals.

The safety watchdog's barrister Andrew Palmer QC said it came after discussions with WorkSafe and the accused, and Eugene's family had been informed.

Wittingslow had been charged with breaching workplace safety laws by failing to ensure people are not exposed to risk.

Eugene was the son of a Wittingslow employee and seated on the ride with another six-year-old when he slipped out from underneath the bar designed to hold patrons in place.

Eugene's mother Tammy White told 9News the decision was "absolutely heartbreaking".

She is now campaigning for a coronial inquest.

"I don't want any other family to go through what we have," she said.

"I will never stop, for my son."

WorkSafe allowed the Cha Cha to reopen two days after the April 17 incident and the ride, which had undergone modifications, can still be operated.

A previous court hearing was told WorkSafe and Wittingslow disagreed about who had been ultimately responsible for managing the safety of the Cha Cha.

Earlier this month, Wittingslow's barrister Stephen Russell said there was no evidence the company knew the Cha Cha's safety measures were inadequate.
