WA sex offender denied prison release

A dangerous sex offender whose crimes included raping a woman after the car they were travelling in ran out of petrol has been denied release by a Perth judge.

In a West Australian Supreme Court judgment released on Wednesday, Justice Bruno Fiannaca said Macker Joseph Dinah continued to be a danger to the community, particularly indigenous women.

"I am satisfied that his risk of committing a serious sexual offence cannot be adequately managed for the protection of the community by a supervision order," Justice Fiannaca said.

Dinah was deemed a dangerous sex offender in 2009 after a series of sex offences dating back to 1984.

He was released under a supervision order in 2011, but returned to prison the following year after several breaches, including cutting off his tracking bracelet and drinking alcohol.

"Until the respondent demonstrates a capacity to abstain from substance use while in the controlled and structured environment of a prison, and develops insight and realistic strategies for coping with problems and stress without resorting to alcohol or drugs, he will not have addressed the issue that was identified as a high risk issue six years ago," Justice Fiannaca said.
