A transgender, HIV-positive prostitute accused of passing the disease on to a man has been granted bail and can now be released from a male prison.

Clayton James Palmer, who identifies as a woman and advertised her services under the name Sienna Fox, is accused of having unprotected sex with a man who was later diagnosed with HIV.

Palmer appeared in the West Australian District Court via video link from prison on Monday for a bail application, having previously had two attempts rejected in the Magistrates Court.

Chief Judge Kevin Sleight ruled the 38-year-old should be released on bail with a $5000 surety and a similar personal undertaking before her trial in February.

"Ms Palmer's transgender presentation is genuine," he said.

The strict bail conditions include surrendering her passport, reporting three times a week to police, no unprotected sex or drug use, and no contact with the complainant.
