Pedophile denied release from WA jail because GPS tracker won't work where he wants to live

One of Western Australia's worst pedophiles has again been denied release from prison because his GPS tracking device will not work in the area he wants to live.

Michael Alexander McGarry, 54, was declared a dangerous sex offender in 2009 after repeatedly abusing young girls.

He was released soon after on a strict supervision order, but returned to prison days later when he breached a condition of his release.

The WA Supreme Court heard during McGarry's fourth annual review that he had been taking anti-libidinal medication for several months.

Justice Stephen Hall said McGarry remained a serious danger to the community and the question was whether he could be adequately managed by a supervision order.

Psychologists and psychiatrists agreed he was suitable for release on a supervision order, but the court heard on Friday the GPS tracker would not work at the accommodation proposed for McGarry.

Justice Hall said as frustrating as it was for McGarry, he could not compromise the safety of the public, which remained his paramount consideration.

"I am not satisfied that Mr McGarry can presently be released on conditions that would be effective in managing the risk that he would commit a further serious sexual offence if released, or in reducing that risk to an acceptable level," he said.

McGarry will remain behind bars until his next review in 12 months.
