Pair guilty of raping drunk Perth woman

Two men have been found guilty of taking turns raping a drunk woman they picked up outside a Perth pub.

Mohamed Al Maialy and Fahed Shgahy approached the victim outside a pub in Northbridge, where she had been drinking with friends, in April 2015.

They then drove to Kings Park and each raped her in the backseat of the car.

In pre-recorded testimony played to a District Court of WA jury last week, the woman said she could only remember part of the attack.

The court heard she had a blood alcohol reading of 0.29 per cent.

She was driven back to Northbridge, where another man came to her aid.

The woman, who is now aged 28, said her stockings had been torn and she was injured.

Prosecutor Mark Hunter told the jury the central issue was whether the woman gave her consent.

"If someone is so affected by alcohol that they are unable to consent then that is rape," he said.

Al Maialy's defence counsel Anthony Elliott agreed consent was the central issue, suggesting the woman's difficulty was her "lack of recollection".

"Having sex with a person you just met is not a crime," he said.

In a police interview, Al Maialy said he didn't have sex in cars and was "more classy than that".

Shgahy's defence counsel Patti Chong said her client believed the woman "engaged fully and voluntarily" in the sex.

"He had no doubt or misgivings," Ms Chong said.

The men were found guilty of aggravated sexual penetration without consent on Monday afternoon and will be sentenced on November 27.
