Lawyers back increase in WA car insurance

Lawyers are pushing for West Australian drivers to be slugged an extra $100 a year to give the state the best car accident compensation scheme in Australia.

The state government is examining three options for a no-fault comprehensive third-party catastrophic insurance scheme for the estimated 44 people every year who do not receive compensation under the existing scheme.

Australian Lawyers Alliance spokesman Phil Gleeson said a no-fault scheme that would cost an additional $101 a car insurance policy every year was the best option.

"Option three would create a safety net for all people injured on the road, which would be backed by a scheme that was financially sound, that didn't slash people's rights and also retained the option for victims to seek lump sum compensation," he said.

"We don't need to dismantle the current system ... we need to add protections for people who are missing out."

The issue made headlines in WA after Warrick Proudlove's family tried to sue the driver of a car in which he was travelling when it struck a horse in 2011, leaving him with catastrophic injuries.

The bid failed and his family is struggling to pay for his rehabilitation and round-the-clock care.

Mr Gleeson urged the government not to follow South Australia, which funded a no-fault motor vehicle accident insurance scheme by slashing the rights to injury compensation for all other road users who suffered serious but not catastrophic injury.

The matter is expected to be debated in the WA parliament on Wednesday.
