Vic woman left out of dad's estate

A woman who sued her brothers after she got nothing from their father's estate has failed in court because her case was lodged one day late.

Mona Younan was left out of her father's will and, with their mother also deceased, her brothers as executors split his estate between themselves.

In his ruling, Justice Kevin Bell said Ms Younan had "strong claims" to a portion of the estate but a statutory six-month period to launch a legal challenge had closed.

She had until April 13, 2015, but papers were not lodged until 14th.

Justice Bell said the will was "not recent" and difficulty obtaining a copy and details of the estate had contributed to the delay.

He noted Ms Younan was elderly and lived in Queensland.

"The court has considerable sympathy for Mona's position," Justice Bell said.

"The court has no power to grant an extension of time because the estate has been finally distributed.

"The remedy for this appalling state of affairs must rest elsewhere."

Neither the brothers - Joseph George Younan and Akram Younan - nor Ms Younan was present in the Victorian Supreme Court on Friday.
