Jail for Vic child porn teacher

A Victorian teacher who filmed up the skirts of his students breached their trust for his own sexual gratification, a Judge says.

Marinko Jankovic, 61, has been jailed for six months after losing a County Court appeal against his sentence for producing and possessing child pornography.

In June the former Berwick Secondary College business management and commerce teacher was convicted after being found in possession of 137 child pornography images.

He admitted using a pen camera to surreptitiously film up the skirts of students at the school between 2011 and 2013.

The court heard he walked around classrooms with the pen in his hand or pocket filming under desks.

He also placed the pen on the ground by his desk and had students stand so he could take pictures without them knowing, sometimes manoeuvring them to get a better angle.

Images were found in files labelled "Anything goes", "Friends" and "I spy", stored on his work laptop in a back-up of his home hard drive.

Defence barrister Rohan Lawrence told the court Jankovic is in ill health and would be more susceptible to infections in prison because of treatment for kidney failure.

He is also remorseful and the community denunciation of his actions had been made clear, Mr Lawrence said.

But Judge Graeme Hicks said a combined prison term and community corrections order were the only way to punish Jankovic.

He said behaviour was a "grave breach" of the trust between Jankovic, his students and their parents.

"You were your students' protector, yet you exploited that for your own sexual gratification," he said.

Jankovic will now have to serve the six-month sentence and two-year CCO imposed by Magistrate Julie O'Donnell.

He will also be listed on the sex offender register for 15 years.
