Vic date rapist 'overcome by passion'

An Egyptian student found guilty of raping three women in Melbourne let "passion overcome reason", and is not as bad as notorious murderer-rapist Adrian Bayley, his lawyer says.

Adel Nafady, 30, appeared before the Victorian County Court on Thursday for a pre-sentence hearing after he was found guilty at separate trials of raping three women he met online.

His barrister David Cronin said Judge Damian Murphy needed to consider "whether passion did overcome reason" in the context of Nafady's crimes when sentencing the former international student.

Nafady faced five trials - including one retrial following a hung jury - between November and March over charges he raped four women in 2015.

He was found guilty of raping three of them, and acquitted of raping a fourth.

The maximum jail term for rape is 25 years.

The prosecution has urged Judge Murphy to reject the argument Nafady was overcome by passion.

"It's not an episode of 'passion overcoming reason'," Peter Chadwick QC said.

"I take issue with that description."

Mr Chadwick said all three women had clearly told Nafady "no" when he raped them within days of each other between April and May 2015.

"He's forcing them, overcoming their will, after they have made it clear to him what their state of mind is," he said.

Mr Cronin said his client did not degrade or humiliate the women after raping them, and offered to call them taxis or let them stay in his flat.

"Some element of kindness is shown to the complainants, which could distinguish this from more serious cases," he said.

"I don't say Adrian Bayley is in any way akin this."

Bayley is serving a 40-year sentence for multiple rapes, including the 2012 rape and murder of Jill Meagher.

One woman, from Colombia, on Thursday said she arrived in Australia in 2015 excited to learn English and "with a suitcase of dreams".

But after Nafady raped, she blamed herself for trusting him and going to his Windsor flat for help writing her resume.

"I thought I was going to die and I felt dirty," she said through a Spanish interpreter.

Nafady, who has been in immigration detention since his student visa was cancelled, is due back in court on May 17.
