Vic police assault 'unsubstantiated': IBAC

There's insufficient evidence to support a man's complaint that a Victorian police officer racially abused and attacked him in 2009, the state's anti-corruption watchdog says.

Nassir Bare, who is of Ethiopian descent, had claimed an officer handcuffed him, kicked his legs out from under him, chipped his teeth and cut his jaw on a gutter after pulling him over in February 2009.

But the Independent Broad-based Anti-corruption Commission (IBAC) on Wednesday said Mr Bare's allegations were "unable to be substantiated".

Mr Bare in mid-2015 successfully appealed a decision of the former Office of Police Integrity not to investigate his complaint, which was originally lodged in early 2010.

IBAC was ordered by the Court of Appeal to make a fresh decision about whether it should investigate.

Commissioner Stephen O'Bryan QC on Wednesday said IBAC had examined the original complaint due to significant public interest in the matter.

"As part of our investigation, we interviewed Mr Bare, the attending police officers, witnesses who were there and other key people, and reviewed available records and documents from the time," the IBAC commissioner said in a statement.

"(But) with Mr Bare's allegations unable to be substantiated, the investigation has now been finalised and closed."

The anti-corruption watchdog found neither the attending police officers nor third party witnesses were able to support allegations the arresting officer racially vilified Mr Bare and used capsicum spray on him while he was handcuffed.

Medical and dental records also did not correspond with the injuries Mr Bare said he'd suffered.

Mr Bare had alleged an officer capsicum-sprayed him several times and said words to the effect: "You black people think you can come to this county and steal cars. We give you a second chance and you come and steal cars."

It was alleged a second police officer kicked Mr Bare, aged 17 at the time, in the ribs while he was on the ground.
