Trial over man fatally hit by car in Vic

A man fatally hit by a car in Melbourne, after arguing with his alleged assailant, had refused to leave a woman's home, a witness told police.

Deer Park man David Majok, 20, has been committed to stand trial charged with the manslaughter of Kuach Deng.

The pair allegedly fought outside Majok's sister's St Albans home in January before Mr Deng was struck by a passing car.

Majok's sister Suzie Majok told police her brother came to her home after she told him Mr Deng refused to leave.

"David told him ... `I told you, I wanted you out'," Ms Majok's police statement, tendered to the Melbourne Magistrates Court, said.

She said Mr Deng was "acting out" outside her home and her brother told him he wasn't coming back in.

She saw her brother punch Mr Deng.

"I started doing the dishes and then I heard an ambulance," Ms Majok's statement said.

Mr Deng had a blood alcohol reading of about 0.25 and traces of cannabis in his system when he died, the court heard during Majok's committal hearing on Tuesday.

"That's clearly five times the legal limit for driving," Majok's lawyer Andrew Jackson said of the alcohol reading.

Majok has pleaded not guilty to one count each of manslaughter, recklessly causing serious injury and assault and was committed to stand trial in the Supreme Court of Victoria.

He is on bail and due to face the Supreme Court for a directions hearing on Wednesday.
