Melbourne footy basher appeals jail time

A son of a prominent Melbourne QC has walked from court after challenging a jail term for a brutal assault on two Melbourne football fans, while his brother and friend remain locked up.

Sam Walker, 25, immediately lodged an appeal after being sentenced at Melbourne Magistrates Court to six months in jail over the attack on September 7 last year.

He has been released on bail until his appeal on February 3.

His brother Dominic Walker, 28, was also sentenced on Tuesday to 12 months jail and their friend Benjamin Fitt, 28, has been ordered to spend four months in jail.

The trio had each pleaded guilty to intentionally causing injury to David Raeside and Leonard Tricarico outside the Pullman hotel, which is a short walk from the MCG, after an AFL game.

The Walker brothers are the sons of Tim Walker QC and the grandsons of pre-eminent scientist Sir Gustav Nossal.

Before the bashing, the victims exchanged words with the trio near the hotel then ran down a side street and waited for 10 minutes.

They then walked back towards the hotel to get a taxi and saw the Walker brothers getting into a cab before Mr Tricarico grabbed Fitt's shirt, court documents reveal.

Mobile vision reveals Sam Walker punching Mr Tricarico on the ground, while his brother Dominic stands over Mr Raeside punching and kicking him.

Fitt moved between the victims to assault them with his fists and feet.

Mr Raeside tried to pull his mate away before Dominic Walker punched him to the ground, kicked his head and shoulder.

When he tried to crawl away, Dominic Walker pulled Mr Raeside back, punched his head 15 more times and yelled "I'm going to f**king kill you", court documents state.

He also stomped on Mr Raeside's head multiple times.

Mr Raeside was left unconscious on the road, suffered bleeding around the brain and broken bones to the face, while Mr Tricarico suffered a broken wrist.

Mr Tricarico now has post traumatic stress disorder.

All five men involved were intoxicated to varying degrees, the court was told.

Sam Walker had a history of drug and alcohol use and has bipolar disorder.

Fitt previously had alcohol-related issues, but has changed his ways, the court was told.

Magistrate Duncan Reynolds ordered the trio serve two-year community corrections orders, which includes a year barred from licensed premises, once they've completed their prison terms.
