Fatal Vic bashing accused denied bail

A former bank clerk accused of fatally bashing a university student outside a Melbourne McDonald's has been denied bail.

Kyle Zandipour, 28, applied for bail in the Victorian Supreme Court on Friday citing exceptional circumstances.

Zandipour is accused of bashing 21-year-old Joshua Hardy outside a St Kilda Road McDonald's in the early hours of Saturday, October 18.

Mr Hardy, a third-year University of Melbourne arts student from Darwin, died an hour later in hospital.

Defence barrister Christopher Dane told the court Zandipour was suffering from depression and a back injury and had been unable to support his frail mother while in jail.

Justice Bernard Bongiorno said there was nothing exceptional about Zandipour's circumstances that would make him eligible for bail.

He said almost anyone arrested, charged and incarcerated goes through what Zandipour was experiencing.

"There's nothing exceptional in not being able to study, to attend the orthodontist, or to help your parents," Justice Bongiorno said.

Zandipour will face a committal hearing at a date to be set.
