Vic driver fails to face court over death

An alleged drink-driver charged with causing the death of his 17-year-old front-seat passenger, possibly also suffered a fractured spine, cracked ribs and a head wound, a Melbourne court has heard.

Brandon Phongthaihong, 21, was allegedly driving a Mazda hatchback with four passengers on board when it crashed into a tree at Tootgarook on the Mornington Peninsula about 1.15am on Friday.

A 17-year-old McCrae boy died at the scene, while two 17-year-olds - from Capel Sound and McCrae - are fighting for life in hospital.

A fourth youth, also 17, remains in a stable condition.

Phongthaihong, who lives in Rye, did to appear in Melbourne Magistrates Court during his filing hearing on Monday, with no explanation given for his absence.

He has been charged with culpable driving causing death and two counts of negligently causing serious injury by driving at excessive speed and under the influence of alcohol.

The court was told Phongthaihong was initially placed in a brace and may have a spinal fracture, cracked ribs, a head wound and be suffering shock.

He may also be a "vulnerable inmate" because of his age and appearance.

The case will involve a drug and alcohol analysis, a mechanical assessment of the car and examination of CCTV footage.

Phongthaihong's lawyer said it was his first time in custody. He did not apply for bail and was remanded to reappear on August 18 for a committal mention.
