Vic driver accused of leaving dying mate

A man accused of leaving his mate to die in a car crash in Melbourne doesn't want doctors to check his injuries as authorities try to prove who was driving.

Michael Glenn Ashlin, 33, appeared before Melbourne Magistrates Court on Tuesday charged over a crash at Wollert on Friday where passenger Owen Sugay was left for dead.

Mr Sugay was trapped but still alive when a passer-by found a Subaru that had crashed into a pole at Wollert on Friday morning.

He died soon after paramedics arrived.

Prosecutor Michael Roper said Ashlin owned the car and police want to examine his injuries to help them determine who was driving.

But the 33-year-old has refused the medical examination.

"He wishes to decline the procedure until he has spoken to his lawyer," a Legal Aid lawyer told the court.

Ashlin was among three people arrested on Sunday over the crash.

He was placed under police guard in hospital and discharged on Monday night.

Mr Roper said a woman has admitted being in the passenger seat.

Ashlin has been charged with culpable driving causing death, dangerous driving causing death and failing to render assistance.

He has been remanded in custody and is due back in court on Wednesday.
