Torun shooting sentence too low: DPP

Prosecutors believe a Victorian judge ignored a background of domestic violence when sentencing a man for accidentally shooting his girlfriend.

Mehmet Torun, 26, was jailed for eight years for the manslaughter of Kara Doyle, who died five days after he pointed a sawn-off shotgun at her and pulled the trigger.

But prosecutors have appealed against the sentence, saying it is inadequate and the judge did not give regard to the ongoing violence Ms Doyle was subjected to by Torun.

Susan Borg told the Victorian Court of Appeal the fact Torun pointed the gun at the 24-year-old while recounting a story was indicative of that violence.

"There were five other people in the room. He does not point it at anyone else and pull the trigger - he points it at her," Ms Borg said.

Justice Michael Croucher accepted Torun did not think the gun was loaded when jailing Torun for a minimum of five years last April.

Torun's barrister Sue McNicol QC said Justice Croucher made no error in his sentence for the 2013 shooting.

She said there was no clear and egregious inadequacy in the sentence, nor was it disproportionate to the seriousness of the crime.

The Director of Public Prosecutions' appeal "does not even stand the 'Oh my god' test", she said.

Justices David Ashley, Simon Whelan and David Beach will deliver their verdict on the appeal at 10am on Friday.
