Vic police can use force on murder suspect

Police have been told they can use force to obtain fingernail scrapings and a swab from a man charged with murder after a woman's body was found in a home in Melbourne's west.

Dursun Yildiz, 49, has been taken into custody and charged with the murder of Seker Yildiz, whose body was discovered in Dallas about 2.20pm on Monday, but he refused to enter the courtroom for his filing hearing on Tuesday.

Yildiz's lawyer Rebekah Haylock told the court Yildiz was extremely paranoid and delusional and struggled to understand when she explained why he needed to appear.

Detective Leading Senior Constable Sean Toohey sought an order that would allow police to document Yildiz's injuries and take fingernail scrapings and a swab.

Yildiz has scratches on the right side of his face and lacerations on his wrist, Det Sen Const Toohey told the court.

"There appears to have been some sort of struggle," he said.

He said a small axe, or tomahawk, had been found on the kitchen floor of a home in Dallas, with what appears to be blood on it, and bloodied male clothing had also been recovered from the scene.

He also said Yildiz had been deemed unfit for interview by a forensic psychologist.

The magistrate granted an order enabling police to use force, if necessary, to obtain the samples from Yildiz.

He said Yildiz was unable to give consent on the grounds of mental impairment.

Yildiz was remanded and will reappear in court on September 1.
