Tears after not guilty Vic rape verdict

A Melbourne real estate agent has sobbed as he was cleared of raping and imprisoning a sex worker in a vacant house.

A Victorian County Court jury spent about three hours deliberating on Thursday before finding Henry Jiang not guilty of the allegations against him.

The 34-year-old was accused of binding the woman with cable ties and raping her repeatedly at a Doncaster property in April 2014 after being told his booking with her had ended.

His defence barrister said everything that happened was consensual, and the woman had agreed to extend her time with Mr Jiang after he offered her more money and drugs.

The jury in Mr Jiang's trial was told he and the woman smoked ice and chatted for about half an hour after she arrived at the property two years ago.

The crown said the pair engaged in consensual sex, but Mr Jiang couldn't perform and asked the woman to stay longer.

Prosecutor Jo Piggott said the woman was preparing to leave when Mr Jiang allegedly grabbed her, bound her wrists and shoved a sponge in her mouth, before raping her repeatedly.

The woman fled the property screaming about 6am when a smoke alarm sounded, Ms Piggott told the jury.

Defence barrister Con Heliotis, QC, said the woman didn't tell her escort agency she was staying later with Mr Jiang because she didn't want to pay them a higher commission.

Mr Jiang admitted taking money from the woman, because he calculated he was owed it for the drugs.

Mr Heliotis said the sex worker was concerned she had been robbed and only claimed she had been raped about half an hour later when asked directly by police.

The defence lawyer told the jury the woman had to get police on her side and "minimise the damage" because she was on a "short leash" with the Department of Human Services.

In explaining the woman's alleged screams as she left the house, Mr Heliotis said: "She would be extremely distressed if she had lost her money and couldn't buy drugs."

Mr Jiang was found not guilty of five counts of rape and one count each of false imprisonment and indecent assault.

He pleaded guilty to one count of theft, related to the woman's money, and will front a plea hearing next week over that charge.
