Just Group v Cotton On case continues

Clothing giant Just Group is appealing against a decision that allowed a former senior executive to work for its competitor Cotton On.

The retailer's case came before the Victorian Court of Appeal on Wednesday and December 15 was locked in for a hearing.

This means Just Group's ex-chief financial officer, Nicole Peck, can't start working for Cotton On until after that date.

Ms Peck began working for Just Group in January and handed in her resignation in May.

Shortly before she finished up, she told Just Group she planned to work for Cotton On from early June.

Just Group, which includes brands such as Just Jeans, Jay Jays, Dotti and Smiggle, sought an injunction from the Victorian Supreme Court that would stop Ms Peck working for their rival.

Ms Peck's Just Group contract included a post-employment restraint clause that barred her from working for 50 different companies for up to 24 months, including Cotton On, according to court documents.

Justice Michael McDonald dismissed the retailer's case earlier this month, saying the restraints on Ms Peck were not reasonable or enforceable.

Just Group is now hoping to appeal against this decision.
