Jail for ruptured eyeball Vic assault

A Melbourne man who ruptured his mate's eyeball during an unprovoked attack, described the assault as a "disagreement between two old friends".

Ashley Moore, 48, pleaded guilty to intentionally causing injury after assaulting his friend, who a judge says could have lost sight - or even his eye - if he hadn't received immediate medical attention.

Moore, who was on bail at the time, welcomed his friend to stay at his home as "he was feeling lonely" on August 25 last year, Judge Scott Johns said when sentencing Moore in the County Court on Wednesday.

The victim, who had previously been diagnosed with depression and post-traumatic stress disorder, arrived at Moore's home with his dog about 9.30pm, but Moore became aggressive.

Moore, who was "drunk and stoned", poked his friend in the ribs, where he knew he'd sustained an injury, and called him a "f***ing girl".

As the victim went to leave, Moore punched him to the right cheekbone, with the man hearing his "face mash, and the sound of something crushing," before he was punched in the same spot again.

The man fell to the ground, with Moore continuing to poke and prod his ribs, with the victim wetting himself in fear.

Moore then offered the victim some ice in a tea towel and "wanted to fix him up".

The man ran away, catching a taxi to the Rosebud Hospital but was transferred to the Alfred Hospital due of the extent of his injuries, undergoing immediate surgery.

He suffered a ruptured eyeball and a fractured cheek, nose and upper jaw, spending five days in hospital and undergoing several operations.

Moore, a disability pensioner, initially denied punching the victim and claimed his guest had refused to leave.

Moore was sentenced to 12 months' imprisonment and a two-year community corrections order.
