The mother of three boys murdered by their father when he drove into a dam in 2005 is seeking compensation for her pain and suffering.

Cindy Gambino was awarded $225,000 in 2009 for her grief at the loss of children Jai, 10, Tyler, seven, and two-year-old Bailey, but the order was set aside when Robert Farquharson appealed his conviction.

Farguharson, 46, was initially found guilty of murdering his three sons by driving them into a Winchelsea dam on Father's Day in 2005.

He successfully appealed his conviction and won a retrial in 2010 before being found guilty again by a jury.

Justice Lex Lasry rejected Farquharson's claims he suffered a coughing fit while behind the wheel, and found he deliberately killed his three boys as revenge against Ms Gambino, who had found a new partner.

Justice Lasry sentenced Farquharson to a life sentence with a 33-year minimum.

Farquharson has until July 31 to respond to Ms Gambino's compensation claim, with a hearing set for August 28.
