Rape charge dropped after new evidence

Police have withdrawn their case against a man accused of raping a 17-year-old girl in a Sydney train station toilet block.

Police on Wednesday decided to withdraw the case against Ben Kooy, 34, when he appeared at Burwood Local Court.

His legal aid lawyer Patricia Lyden told the court that new evidence had "changed the situation".

Mr Kooy told reporters outside court he was relieved.

"I'm just glad it's over," he said as he left the court.

He was arrested and charged with sexual intercourse without consent after the alleged attack at Strathfield station last Wednesday.

Mr Kooy appeared at Burwood Local Court last week and was refused bail.

Police said on Monday that following further investigations, detectives had applied to have fresh evidence heard in court.

That evidence was put before a magistrate in the Parramatta Bail Court on Sunday resulting in Mr Kooy being released on bail.

His father, who also in court on Wednesday, said he was "very happy" with the outcome.
