Qld bomb hoaxer given two years' probation

An intellectually-impaired man who fell in with a group of manipulative pranksters didn't intend harm when he taped a fake bomb to a Brisbane park toilet, a court had heard.

Nicholas Aaron Roccisano, 30, was placed on a two-year probation on Wednesday in the Brisbane District Court after pleading guilty to staging the January 2016 bomb hoax.

After planting the elaborate wire-and-tube rig at Captain Burke Park, under the Story Bridge, Roccisano asked people if they had seen any suspicious characters about as there was a bomb in the toilet.

Parts of riverside suburb Kangaroo Point were locked down after he taped the dummy rig to a cubicle.

"Eventually the device was x-rayed and it obviously wasn't explosive, and it was something you'd just put together for the purpose of a hoax," Judge Brendan Butler said.

"It seems you wanted to video this and put it on YouTube."

The court heard that before the bomb hoax, Roccisano hung out with pranksters who may have taken advantage of his mental condition

In sentencing him to two years'receive probation, Judge Butler found he didn't intend harm and didn't realise the consequence of his actions.

"You didn't do it for any malicious purpose, you didn't do it to strike fear into people or to hurt anyone or as a threat or in order to extort anything from anyone," he said.

After being charged with placing an article and falsely stating a bomb was present Roccisano spent 57 days in custody.

"It seems to me that that period of imprisonment is sufficient to deter you from further offending and to publicly mark the seriousness of the offence," Judge Butler said.

As part of his probation conditions Roccisano must be assessed by a psychiatrist and undergo counselling and receive medication.
