A Zimbabwean-born circus performer jailed for infecting his girlfriend with HIV has had the conviction quashed by the High Court.

The court upheld Godfrey Zaburoni's appeal against his nine-and-a-half year sentence, finding there was "no evidence" that the 37-year-old intended to transmit the disease.

The man will now be re-sentenced in the District Court of Queensland on a lesser charge.
