Let Labor form Qld govt: Wellington

Queensland's governor should allow Labor to form government so the state isn't left in limbo for months, aspiring kingmaker Peter Wellington says.

Labor is currently holding the in-dispute seat of Ferny Grove, meaning that with the support of the independent MP the party will have the 45 seats required to form a minority government.

But the result in the northern Brisbane seat is being disputed because a Palmer United Party candidate was discovered to be an undeclared bankrupt.

The Electoral Commission of Queensland will refer the results in Ferny Grove to the Court of Disputed Returns after returning the writs for the state wide figures.

The court will then determine if the poll in Ferny Grove was valid and whether Mr Taverner's preferences would have affected the final result.

But Mr Wellington says that process could take over a year, and Queensland Governor Paul de Jersey should end the current uncertainty by allowing Labor to take over from the caretaker Liberal National Party government.

"The fact is that it was won by Labor and Labor is entitled to include that seat in their claim to govern," he wrote on Facebook.

"It is unreasonable to expect Queensland to remain in a state of limbo until the outcome is known.

"The governor has the responsibility to hand the reins of government to whoever is able to deliver the 45 seats and should not be drawn into hypothetical scenarios involving the future of the electorate of Ferny Grove."

Mr Wellington said it was "farcical" for new Liberal National Party leader Lawrence Springborg to be holding onto power until the Court of Disputed Returns had made a decision.

The LNP, which is projected to win 42 seats, hope to gain the allegiances of the two Katter's Australian Party MPs, Rob Katter and Shane Knuth, and also win back Ferny Grove in a by-election.

Campbell Newman is still technically the state's premier - even though he lost his own seat - until the writs are returned and he resigns on Tuesday.
