Baden-Clay appeal ruling on Thursday

Australia's highest court will announce on Thursday whether it will allow an appeal seeking to reinstate Gerard Baden-Clay's murder conviction.

The High Court of Australia will decide in Canberra if it will allow the Queensland Director of Public Prosecutions to appeal Baden-Clay's downgraded conviction of manslaughter.

The court will hand down one of three decisions in open court.

It will either grant special leave to hear the appeal or refer to the full bench to hear it, refuse the application or ask for further oral submissions before it makes its decision.

The DPP applied for special leave to appeal Baden-Clay's manslaughter conviction, after community outrage over his reduced culpability in the death of his wife Allison in April 2012.

Baden-Clay was convicted of her murder in 2014, but that was downgraded to manslaughter last year by the Queensland Court of Appeal after his lawyers argued he could have unintentionally killed his wife.

The appeals court ruled it could not be proved beyond reasonable doubt that Baden-Clay intended to kill Allison.
