Gold prospector murderer lodges appeal

A cattle station owner sentenced to life in jail for killing a gold prospector on his remote Cape York station will appeal his murder conviction.

Stephen Roy Struber, 58, and his wife Dianne Rose Wilson-Struber were last month found guilty of murdering 48-year-old Bruce Schuler in July 2012 and interfering with his corpse, which has never been found.

Struber's solicitor, Paul Richardson, on Monday said he could not finalise separate 2011 charges of wilful damage and contravening a direction until after the appeal, filed within the last fortnight, was finalised.

"Should Mr Struber be successful in his appeal, the Crown may reassess the way in which they conduct their prosecution," he told Cairns Magistrate Court on Monday.

The Palmerville Station owners received a mandatory life sentence for Mr Schuler's murder.

Mr Richardson said he had received the entire transcript of the Supreme Court trial and thought counsel addresses and summing up may be considered by the Court of Appeal.

A hearing date for the appeal has not yet been set.

The lesser charges are listed in Cairns Magistrates Court on November 25.
