Conman Peter Foster is to find out whether he will get out of jail early.

Foster, 53, has six months left to serve of an 18-month jail sentence over his last weight-loss scam.

Justice John Longman will deliver his judgment on Friday, ruling whether Foster will be allowed to leave the Brisbane Correctional Centre early.

A hearing to consider an early release was held in the Federal Court in Brisbane this week behind closed doors.

Barrister Saul Holt QC convinced Justice Longman to close the court, because public knowledge of a new factor in the conman's case was "likely to have profound consequences".

Foster was in October 2013 ordered to serve 18 months of a three-year prison sentence for breaching court orders that banned him from the weight-loss industry.

It was over his involvement in the $6 million SensaSlim oral diet spray scam.

The notorious conman went into hiding and made it appear as though he was in Fiji.

However he was tracked down a year ago disguised as a hippie and living near Byron Bay in northern NSW.
