Prison fears help bikie suspect get bail

An alleged bikie jailed over a drinking session at a Sunshine Coast hinterland pub has been granted bail.

Paul Lansdowne, 57, was one of five alleged Rebels gang members or associates arrested last month under new anti-bikie laws banning gang members from gathering in public.

Police claim the group drank together at the Yandina Hotel on November 1 last year.

Lansdowne's bail application in the Brisbane Magistrates Court last month was knocked back but on Wednesday Supreme Court Justice John Byrne granted bail, saying his risk of reoffending was "not unacceptable".

The judge said although there was strong evidence Lansdowne was a "patched" Rebels member and he was facing separate drug-trafficking charges, he had complied with bail conditions in the past.

Lansdowne had also proposed to stay away from Rebels members, while his anxiety not to return to solitary confinement was a "substantial incentive" not to reoffend, the judge said in his written reasons.

Prisoners with bikie links are being held in cells for 23 hours a day under the Newman government's bikie crackdown.

"There is not an unacceptable risk that the applicant would commit an offence pending trial," Justice Byrne said.

On Tuesday alleged Rebels associate Joshua Carew was granted bail by the same judge.

Only one of the five men, alleged Rebel Steven Smith, remains behind bars after two bail applications were unsuccessful.

Dan Whale and Scott Conley were released on bail last month.

The five face a mandatory six months' imprisonment if found guilty of being participants in a criminal organisation and being knowingly present in public places with two or more people who are participants.

Their trial has been set down for late March.
