Couple takes neighbours to court over 'annoying' sports balls

A Perth couple has taken a neighbourhood dispute to court, angry over children kicking sports balls into their backyard.

In a writ lodged to the WA Supreme Court, Peter and Lynda Walton claim the balls being kicked and thrown over the fence have ruined the “enjoyment” of their $1.4m Bicton home, adding that having to “constantly return” the sports balls is an “annoyance”.

To support their argument, they claim to have been taking photos of the sports balls in their yard as far back as February 2016.

They also claim the same neighbours have caused around$15,000 worth of damage to their brick wall by attaching a kid’s cubby house and installing a pool and a shower without permission.

The Waltons argue they are the sole owners of the dividing brick wall, as it falls within their boundary.

If the court action is successful, the neighbours could have to pay for the damage to the wall, remove the shower and cubby house and ensure no more balls land in their neighbour's yard.
