Second NT judge keeps Voller case

The second judge in the civil lawsuit of former Northern Territory youth inmate Dylan Voller has refused an application to step aside from the case.

The 20-year-old and fellow former Don Dale Detention Centre detainee Jake Roper are suing the NT government for damages over their alleged mistreatment in August 2014 when they and four other boys were tear gassed.

On Friday in the Supreme Court, Justice Peter Barr refused to recuse himself following an application from Voller's lawyer, who raised concerns over his findings in the appeal of a former guard who was acquitted for assaulting the then 13-year-old in 2010.

It follows the departure of Justice Judith Kelly, who in March ruled that the use of tear gas was both "reasonable and necessary" in a separate civil lawsuit brought by the other four boys.
