Sydney pedophile not high risk, court told

A Sydney pedophile accused of raping a teenager hours after his release from prison was not deemed a high-risk sexual offender, court documents show.

Rather, Arthur Alliband was an "impulsive person with limited social skills and a substance use disorder", a District Court judgment from his previous child sex sentencing said.

Alliband was arrested on Tuesday for allegedly raping a 16-year-old girl at a western Sydney park a few hours after he was released from jail on Monday.

The 26-year-old had been serving time for having sex with a child aged between 10 and 14 after being sentenced to 18 months in jail in December 2015, backdated to August 2014.

In handing down the sentence, District Court judge John Delaney said Alliband may have had "some form of mental illness" when he began a consensual sexual relationship with a teenage girl he met at a refuge centre.

Judge Delaney referred to a report from a psychologist who had diagnosed Alliband as suffering from a developmental disability at the time of his arrest.

On the psychologist's view about Alliband's future, Judge Delaney said: "He thought that the offender was not a high risk sexual offender but rather an impulsive person with limited social skills and a substance use disorder".

The psychologist had made it clear Alliband would need assistance with accommodation, employment and supervision to abstain from drug use once he was released from prison, Judge Delaney said.

Alliband was charged with two counts of sexual intercourse with a person aged between 10 and 14 - offences which carry a maximum penalty of 16 years.

But in sentencing Alliband to a non-parole period of 18 months over the two offences, Judge Delaney said the case was at a "very low level of criminality compared to other offences of this type".

That's because it did not involve any threat, coercion, violence or anything at all to encourage the child to have sex, the court heard.

Alliband was refused bail on Wednesday after being charged with sexual intercourse without consent and assault with act of indecency over Monday's alleged assault.

The NSW State Parole Board revoked his parole later that day, adding that Alliband had been automatically released on parole by the courts as his sentence was less than three years.
