NSW man, 102, has assault charge dismissed

A 102-year-old man who indecently assaulted a fellow Sydney aged-care resident has had the charge dismissed on mental health grounds.

The centenarian pleaded guilty in Waverley Local Court on Monday to unzipping the fly of his pants and exposing himself to a 94-year-old woman on October 23 before grabbing both of her shoulders with his hands.

A nurse at the facility witnessed the incident, including hearing the cognitively impaired woman twice say "no", and notified authorities, according to the police facts.

The aggravated indecent assault charge was dismissed under Section 32 of the Mental Health Act and the man was discharged unconditionally.

An AVO application by police on behalf of the elderly woman is likely to be withdrawn in court on December 20.
