NSW drunk driver remains behind bars

A drunk driver whose teenage friend died after she was thrown from his car will remain behind bars after his bid to appeal against his conviction was refused.

In the Sydney Supreme Court Michael John Severino, 27, on Friday was denied leave to appeal after he argued comments he made to police officers on the night of the crash should have been inadmissible.

Kaleigh Fryer, 19, died in the April 2014 crash after Severino lost control of his Toyota Corolla while negotiating a turn in Terrey Hills in Sydney's north.

The jury in Severino's 2015 trial heard he told police at the scene he was not going to admit to being the driver as he did not want to "incriminate himself".

The Court of Criminal Appeal on Friday ruled his comments to police were not inadmissible and there'd been no miscarriage of justice during his trial.

Severino was found guilty of dangerous driving causing death by a NSW District Court jury in August 2015 and sentenced by Judge Donna Woodburne to at least four years in prison.

He will be eligible for parole in August 2019.
