A controversial Ombudsman's report into a NSW Police bugging scandal will not be released before a judge hears an application by former deputy commissioner Nick Kaldas to stop it ever being published.

The report looks into allegations that 114 officers, including Mr Kaldas, were illegally bugged during a NSW Police internal affairs unit investigation, and was set to be published imminently.

In the Supreme Court on Thursday, lawyers for the Ombudsman undertook not to publish the report before December 19, after the hearing was set down for the 16th.
