Alleged NSW lawyer murderer to be retried

A woman found guilty of murdering Wollongong lawyer Katie Foreman will be retried after successfully appealing her conviction.

It is the Crown case that Michelle Sharon Proud was part of a joint criminal enterprise, along with Wendy Evans, Bernard Spicer and Bradley Rawlinson, to kill or badly injure the solicitor by setting fire to her home as she slept.

Prosecutors alleged at trial that Evans and Spicer crept into the 31-year-old's Corrimal house in the early hours of the morning of October 27, 2011, doused her bedroom in petrol and set it alight, and that Ms Foreman was unable to escape the flames.

On Monday, the NSW Court of Criminal Appeal found the trial judge had made an error in his summing up, and ordered that Ms Proud's conviction and sentence for murder be quashed and a retrial held.
