Sydney millionaire avoids jail over infamous drink driving episode

He was the shameful star of a video which showed why you shouldn't drink and drive.

In November last year, a CCTV camera caught millionaire high flyer, Matthew Duncan literally fall out his BMW after a drinking session in Woolloomooloo.

He was so drunk he could barely stand and by the time police arrived a road side check confirmed the obvious.

The former executive of the Trivett motoring group had a blood alcohol limit of .342.

He only just returned behind the wheel after notching up two earlier drink driving convictions.

In March, a magistrate threw the book at him stating "it was sheer good luck” that he didn't kill anyone.

He was jailed for a minimum eight months but spent less than two hours in handcuffs before he appealed and was granted bail.

Today, Duncan walked into court, clearly sober and sorry, as he attempted to dodge going to jail.

He applied and was granted a correction services order which means instead of prison time he will spend the next 15 months under strict supervision while on the outside.

He could also be eligible to get his licence back as early march.

The 39-year-old refused to answer questions as he walked court.

Whether he likes it or not Mathew Duncan will be remembered for that video.

It will haunt him, but he knows he is lucky that it didn't help send him to jail.
