Man charged over fatal Ryde stabbing could have charge upgraded

A 20-year-old Sydney man charged over a brawl that saw a 16-year-old fatally stabbed may have his charge upgraded, a court has been told.

Jacob Lusted, 20, did not appear or apply for bail in Parramatta Local Court this morning when he was formally charged with affray over the death of 16-year-old Aiden Smith at a party in Ryde last Saturday night.

Seven others were also received wounded during the brawl, including the 20-year-old accused, who remains under police guard in hospital.

No plea was entered on his behalf, however police made an application for forensic procedure, which could lead to an upgraded charge from affray to manslaughter or murder.

Aiden's sister, Nova Smith, said her brother was "always happy".

"He was always with his friends, always with his family, just always happy and making others happy," Ms Smith said. 

Aiden's funeral will be held tomorrow.

The case has been adjourned to Burwood Local Court on August 24.
