Ex-wife of Victorian man who drowned their three children on Father's Day to get his money

The mother of three boys who died 10 years ago when their father drove them into a Victorian dam will get all of his money.

Cindy Gambino's compensation claim against her ex-husband Robert Farquharson has been resolved, the Victorian Supreme Court heard when the case was mentioned in court today.

Farquharson is serving a life sentence after twice being found guilty of the murder of Jai, 10, Tyler, 7 and two-year-old Bailey Farquharson on Father's Day in September 2005.

He was returning home from an access visit when he drove his car off the Princes Highway and into a dam near Winchelsea.

While he swam free, his sons drowned.

His trial heard the murders were to punish Ms Gambino.

Farquharson was ordered to pay his ex-wife $225,000 compensation in 2009 after being found guilty of the boys' murder in 2007.

But the payment order was overturned when his conviction was quashed on appeal in December 2009.

He was again found guilty in 2010 and sentenced to life with a minimum of 33 years.

After a subsequent application to appeal was denied by the full bench of the High Court in 2013, Ms Gambino filed another compensation claim.

Farquharson appeared in the Victorian Supreme Court via video link today where Justice Lex Lasry was told by lawyers for both him and Ms Gambino that the matter had been resolved.

When Justice Lasry asked if the value of the claim was anything like the original order, barrister Adam Hill, for Ms Gambino, indicated she would get all of the available money.

"There's a finite pool and the ultimate outcome is that pool," Mr Hill told the court.

The matter will return to court in November, for final approval by the court.
