Emma Husar considers legal action to keep seat

Spurned federal Labor MP Emma Husar is considering launching court action against her party as she fights to hold onto her western Sydney seat.

Ms Husar announced in August she would not contest the next election, as she face an internal investigation into staff bullying allegations.

However, the member for the New South Wales seat of Lindsay has since changed her mind and has rejected suggestions she is no longer the Labor candidate for next year's federal poll.

NSW Labor executives will meet tomorrow to settle on a preselection process to replace Ms Husar.

But she has told The Australian she will fight the process through the courts if necessary.

Ms Husar has deliberately missed votes in parliament and Labor caucus meetings in recent weeks as she pushes back against the party.

She has also threatened to defect to the crossbench.
