Bail refused for man facing terror retrial

A Sydney man accused of plotting to blow up an Etihad plane with a bomb hidden in a meat grinder has been refused bail pending his retrial.

Mahmoud Khayat, 34, is facing a NSW Supreme Court retrial in August, after a jury was discharged in May after failing to agree on a verdict.

The jurors found his brother Khaled Khayat, 51, guilty of the same charge of conspiring, between mid-January and late-July 2017, to prepare or plan a terrorist act.

The trial judge, Justice Christine Adamson, on Thursday dismissed the younger brother's bid for bail.

His lawyers had not shown that "exceptional circumstances existed" in his case to enable the granting of bail, as was required by the relevant law, she said.

Justice Adamson acknowledged Khayat had been in custody since his arrest in July 2017, but said that wasn't exceptional in the context of the case.
