Alleged police killer to be retried

Alleged police killer David Eastman will face a retrial over the death of Australian Federal Police assistant commissioner Colin Winchester, it has been reported.

Mr Eastman's conviction for the 1989 murder was quashed in August and he was released from prison.

But the ACT Director of Public Prosecutions, Jon White SC, says he will be seeking a date for a retrial when the matter comes before the ACT Supreme Court on Tuesday.

"Mr Eastman is entitled to the presumption of innocence. Pending the trial, the DPP will make no further comment about the matter," Mr White told Fairfax on Saturday.

Sydney barrister Murugan Thangaraj SC will prosecute the case.

Earlier this year, an inquiry into Mr Eastman's trial concluded there had been a miscarriage of justice and recommended his conviction be quashed.

He was released on August 22 after reluctantly agreeing to a series of bail conditions, including that he notify police of travel plans, not approach anyone on a list of people and that he not apply for a passport.

Since then he's remained out of public view at an unknown address.
