Battle under way to get MP booted from parliament

A constitutional battle is under way to get Gareth Ward, who is sitting in jail, booted from parliament.

The NSW MP was found guilty by a jury of four charges on two young male victims, including one count of sexual intercourse without consent and three counts of indecent assault.

He has refused to resign and has engaged lawyers from behind bars.

Under the state's constitution, an MP's seat is declared vacant if they're convicted of a serious crime, although in NSW that can't happen until the appeals process is over.
